An IOP Certificate issued by the TCEQ offers liability immunity for chemical impacts originating from off-site sources and may be a useful tool to support a real estate transaction or obtaining lender financing.

EnviroPhase has obtained numerous Innocent Owner/Operator Program (IOP) certificates on behalf of affected property owners. EnviroPhase can perform an evaluation to determine if a site qualifies for IOP protection, and has experienced a 100% success rate, to date, in obtaining IOP certificates on behalf of our clients.

It should be noted that an IOP Certificate is not transferrable to future property owners but the possession of an IOP Certificate by a current property owner is indicative the TCEQ has previously concurred with a property’s innocence related to chemical impacts on a property. Since chemical concentrations tend to degrade over time, a new IOP application with confirmation soil or groundwater sampling by new or prospective property owners is often required to verify the property continues to be affected by chemical impacts from off-site sources.
