Voluntary Cleanup Program (VCP)
The Voluntary Cleanup Program (VCP) is administered by the TCEQ, and focuses on investigating and cleaning up soil and groundwater contamination from current or past site activities. Typically the process involves installing soil borings and monitoring wells to collect samples.
Cleanup may include risk-based evaluations, soil excavation or treatment, groundwater remediation, and/or deed restrictions to limit exposure. Completion results in a Certificate of Completion (COC), which provides liability protection to future landowners and lenders. Properties with historical or current commercial and industrial uses, such as dry cleaning, auto repair, and manufacturing can benefit from the VCP.
Innocent Owner/Operator Program (IOP)
The Innocent Owner Program (IOP), is administered by the TCEQ and offers liability relief for property owners impacted by off-site contamination. The IOP can be used as a redevelopment tool and as a tool to add value to contaminated property by providing an Innocent Owner/Operator Certificate (IOC). However, unlike the VCP release of liability, the liability immunity acknowledged in IOCs does not cover future New owners/operators may need updated sample results for a new application

Industrial & Hazardous Waste Corrective Action Program (IHW)
The Industrial & Hazardous Waste Corrective Action Program (IHW) is administered by the TCEQ and addresses chemical impacts from industrial or municipal waste and oversees the closure of waste management units.
Investigations typically include soil borings and groundwater monitoring to assess contamination. Cleanup may involve excavation and disposal of affected soils, removal or closure of waste structures, and risk-based evaluations to determine appropriate actions.
Completion of required activities can result in a No Further Action (NFA) letter from the TCEQ. This program applies to sites with industrial, manufacturing, auto repair, or dry cleaning operations where chemical impacts are suspected or confirmed.
Municipal Settings Designation (MSD)
A Municipal Setting Designation (MSD) restricts the use of groundwater for potable use, enabling higher, less stringent cleanup levels. Sites must have groundwater exceeding TCEQ TRRP Tier 1 Protective Concentration Levels and be enrolled in a TCEQ cleanup program. MSDs eliminate the “groundwater ingestion” pathway as a health concern and can lead to regulatory closure. They may cover single or multiple adjoining properties.
